1. Acceptance of Terms

By creating an account, submitting a trip request, sending a quote, or otherwise using any feature of QuoteMyTrip.in ("the Platform," "we," "us," or "our"), you ("User") agree to comply with and be legally bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated here by reference.

We reserve the right to update these Terms at any time. Continued use of the Platform after changes are published constitutes your acceptance of the revised Terms. We will notify registered users of material changes via email or a prominent notice on the Platform.

2. About the Platform

QuoteMyTrip.in is a travel quotation marketplace that connects travelers seeking holiday packages with verified travel agencies. We are a technology platform and marketplace — we are not a travel agency and do not sell, book, or operate any travel services ourselves.

The Platform enables travelers to post trip requirements, receive personalized quotes from multiple agencies, compare offerings, and initiate direct contact with their chosen agency. All contracts for travel services are entered into directly between the traveler and the travel agency — QuoteMyTrip.in is not a party to any such contract.

We do not guarantee the accuracy of any information provided by agencies, the quality of any travel service, or the outcome of any booking made through connections facilitated by the Platform.

3. Marketplace Disclaimer

Travellers are strongly advised to:

• Verify the agency's credentials, GST registration, and trade license independently
• Read the agency's own cancellation and refund policy before paying
• Avoid paying large advances to unverified or newly registered agencies
• Obtain all trip details, inclusions, and exclusions in writing before making payment
• Never pay via informal channels (personal UPI, cash) without a proper receipt/invoice
• Consider purchasing independent travel insurance for financial protection

QuoteMyTrip.in's "Verified" badge indicates only that we have reviewed certain documents submitted by the agency — it does not constitute a guarantee of the agency's quality, financial stability, or future performance.

4. User Accounts

Eligibility: You must be at least 18 years of age to create an account or use the Platform. By registering, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.

Accuracy of Information: You agree to provide accurate, current, and complete information during registration and to keep your account information updated. Providing false information — including misrepresenting your identity, agency credentials, or GST registration — is grounds for immediate account termination.

Account Security: You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at sales@xigmapro.com if you suspect unauthorized access. We are not liable for any loss arising from unauthorized use of your account.

One Account Per User: Each traveler and each agency may maintain only one active account. Creating duplicate accounts to circumvent restrictions is prohibited.

5. Traveler Terms

Free to Use: Submitting trip requirements and receiving quotes is completely free for travelers. QuoteMyTrip.in does not charge travelers any fee for using the Platform, now or in the future (unless explicitly disclosed in a separate premium feature).

Quotes Are Not Bookings: A quote received through the Platform is an offer, not a confirmed booking. No travel reservation is made by submitting a trip request or receiving a quote. Bookings are confirmed only when you enter into a direct agreement with the travel agency and make the necessary payment to the agency.

Direct Contracts with Agencies: Once you select an agency and proceed, your relationship is exclusively with that agency. You should carefully review the agency's own terms, cancellation policy, and payment terms before making any payment. QuoteMyTrip.in is not responsible for any disputes, non-performance, or losses arising from your agreement with an agency.

Genuine Inquiries: Travelers are expected to submit genuine trip requirements. Submitting fake or frivolous requests wastes agency resources and may result in account suspension.

6. Agency Terms

Subscription Required: Travel agencies must hold an active paid subscription to access lead details and send quotes to travelers. Free registration allows agencies to create a profile, but sending quotes requires a valid plan.

Accurate Information: Agencies must provide truthful and accurate information in their profile, including business name, GST number, trade license number, contact information, and specializations. Any quote sent to a traveler must accurately reflect what the agency is able and willing to provide.

No Spam or Off-Platform Solicitation: Agencies may not use traveler contact details obtained through the Platform for any purpose other than responding to that traveler's specific request. Bulk messaging, unsolicited marketing, or sharing traveler data with third parties is strictly prohibited and will result in permanent account termination.

Verification: Agencies must complete our verification process (document submission and phone verification) before receiving the "Verified" badge. We reserve the right to revoke verification if an agency fails to maintain the standards required or receives substantiated complaints.

7. Quote Process

Quotes submitted by agencies through the Platform are non-binding proposals. They become binding only upon a separate written agreement between the traveler and the agency, typically accompanied by a booking deposit.

QuoteMyTrip.in is not a party to any booking, itinerary, or travel contract. We do not mediate disputes between travelers and agencies, though we may, at our discretion, investigate complaints that involve violations of these Terms.

Travelers should verify all quote details — including inclusions, exclusions, hotel names, check-in/check-out dates, visa arrangements, and total pricing — directly with the agency before making any payment.

8. Subscriptions & Payments

Agency Subscription Plans: QuoteMyTrip.in offers monthly and annual subscription plans for travel agencies: Starter (₹999/month), Growth (₹2,499/month), and Premium (₹4,999/month). Plan features, quote limits, and pricing are detailed on our Pricing page and are subject to change with 30 days' notice.

Auto-Renewal: Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date. You can cancel your subscription at any time from your agency dashboard. Cancellation takes effect at the end of the current billing period.

Refund Policy: We offer a 7-day refund if you have not sent any quotes since the start of your current billing period. Refund requests beyond this window, or where quotes have been sent, are not eligible for a refund. To request a refund, contact sales@xigmapro.com within 7 days of your billing date.

Payment Processing: All payments are processed securely by our third-party payment processor. We do not store your complete card details on our servers. All prices are inclusive of applicable GST.

9. Content & Intellectual Property

Your Content: By submitting trip requirements, quotes, reviews, or any other content to the Platform, you grant QuoteMyTrip.in a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content in connection with operating and promoting the Platform.

Our IP: The QuoteMyTrip.in brand, logo, website design, software, written content, and all other Platform materials are the exclusive property of QuoteMyTrip.in or its licensors. You may not copy, distribute, modify, or create derivative works from our content without prior written permission.

No Scraping: Automated scraping, crawling, or data extraction from the Platform without our express written consent is prohibited. Any violation may result in legal action under applicable Indian law.

10. Prohibited Activities

You agree not to engage in any of the following:

• Submitting false, misleading, or fraudulent information
• Impersonating another person or entity
• Using the Platform for any unlawful purpose
• Posting offensive, defamatory, or abusive content
• Interfering with the technical operation of the Platform
• Attempting unauthorized access to other users' accounts
• Soliciting travelers outside the Platform to avoid paying subscription fees
• Posting fake reviews or ratings about agencies or travelers
• Using the Platform to advertise services unrelated to travel
• Distributing malware or engaging in phishing activities

Violations may result in immediate account suspension or termination, and we reserve the right to pursue legal remedies where applicable.

11. Limitation of Liability

To the maximum extent permitted by applicable law, QuoteMyTrip.in and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, loss of goodwill, or personal injury — arising out of or in connection with your use of the Platform.

QuoteMyTrip.in's total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to us in the three months preceding the claim.

We are not responsible for the actions, omissions, quality, or safety of any travel agency listed on the Platform. Travelers deal with agencies entirely at their own risk and are advised to conduct independent due diligence before making any payment.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts located in Kolkata, West Bengal, India. By using the Platform, you consent to personal jurisdiction in Kolkata and waive any objection to venue in that location.
